Qualification requirements to Licensee of Category 1 to engage in project activities [1] 

Situation

A company with a 6-year experience in the field of design as a licensee of Category 2 applied for the licensee of Category 1 to engage in project activities.

What are the qualification requirements to the licensee in such case and what is the list of documents confirming the compliance with these requirements?

Analysis of the situation

By Resolution of the Government of the Republic of Kazakhstan #89 dated 05.02.2013 "On Some Issues Concerning the Licensing of Activities in the Field of Architecture, Urban Planning and Construction", the “Qualification Requirements and the List of Documents Confirming the Compliance with Them, to Carry Out Activities in the Field of Architecture, Urban Planning and Construction” (hereinafter the Qualification Requirements) were approved.

By Resolution of the Government of the Republic of Kazakhstan #166 dated 02.28.2014 the above-mentioned resolution was amended, and the Qualification Requirements were amended as well.

According to the Qualification Requirements in the new edition (Section 2 "Project Activities", Sub-section 2.3) following qualification requirements are set to legal entities as the applicants for a licensee of Category 1, to engage in project activities:

  1. The availability in the staff of at least one engineer who has an adequate higher education in the field of project activities with the length of service (work experience) of no less than five years in the specialization that is among the requested subtypes of the licensed type of activity, or the adequate vocational or technical and vocational education in the field of project activities with the length of service (work experience) of no less than seven years in the specialization that is among the requested subtypes of the licensed type of activity, as well as the admission to work in areas of high seismic risk for the persons in charge of the performance of work;
  2. The availability of a production base in ownership (for economic purposes or operational management) which has: a) administrative and industrial buildings or premises, necessary to carry out the declared types of work, the subtype of the licensed type of activity; with this, the administrative, industrial and other buildings or the premises of the industrial base can be combined, providing that it is not inconsistent with the HSE requirements in the carrying out of operations; b) working places organized in accordance with the working conditions;
  3. The availability of materials and technical equipment in ownership (for economic purposes or operational management) and/or in lease, including personal computers with installed software that allows making calculations, preparing and developing graphics and other materials, necessary for the declared subtypes of the licensed type of activity;
  4. The availability of a guidance for the quality control system approved by the applicant (licensee), which regulates the proper performance of works and quality assurance (normative control, work production quality control, quality control of project and its sections);
  5. The availability of rules and guidance for the HSE system approved by the applicant (licensee), with the documents attached confirming the training of a relevant engineer/technician in charge;
  6. Licensee’s work experience of no less than ten years, or at least seven years for the person carrying out project activities (design and survey as part of project activities) for offshore oil and gas projects in the Republic of Kazakhstan, or work experience of at least five years as a licensee of Category 2 (the work experience shall be taken into account, starting from the date of issue of the license);
  7. The availability of at least ten implemented construction projects of the first and/or second level of responsibility as a general contractor, with presentation of a document evidence (copies of the signed statements of commissioning), or the availability of no less than twenty constructed facilities of the first and/or second level of responsibility, in which the licensee performed work under subcontracts, with presentation of a document evidence (copies of the signed statements of completion);
  8. At least five positive feedback from the customers and/or operators of the implemented construction projects as a general contractor, or at least ten positive feedbacks on the subcontracts, or, if not possible to provide feedbacks from the customers and/or operators, then from the interested local executive bodies;
  9. No more than 20% of the total number of engineering and technical personnel of the licensee working on job combination.

To be assigned Category 1 in order to engage in project activities, the Company (licensee) is required to produce the following documents confirming its compliance with the above-listed qualification requirements:
