What requirements have the participants to comply with to participate in the bids for the construction of power generating plants newly commissioned?
Analysis of the situation
According to the Rules of the bids for the construction of power generating plants newly commissioned (Item 13), approved by Resolution #446 of the Government of the Republic of Kazakhstan dated May 2, 2013, the participants that meet the below-listed criteria are allowed to participate in the bids for the construction of power generating plants newly commissioned:
- Legal capacity of the participant for entering into a contract with the bids organizers.
- Availability of financial resources and materials sufficient for the construction of power generating plants newly commissioned with the share of funding from its own funds of not less than 30% of the total cost of electric power.
- Absence of tax in arrears for a period not exceeding three months, as of the date of submission of the application for participation in the bids.
- No pending litigation or delivered judgments of bringing to liability for failure to perform or improper performance of its obligations under the contracts concluded over the past five years, or similar contracts with governmental agencies and organizations.
