Order #165 of the Republic of Kazakhstan’s Minister of National Economy of July 28, 2016 amended the Rules for Determining the General Procedure for Referring Some Buildings and Structures to Technically and/or Technologically Complex Facilities (further the "Rules").

These Rules set criteria for determining the complexity of a facility for designing. There are three levels of responsibility for the buildings and structures designed:

  • Level 1 - High
  • Level 2 - Normal
  • Level 3 – Low.

Amendments to the Rules, which were made on July 28, 2016, are as follows:

  1. Regarding the facilities with the high level of responsibility:
  • The wording of the health care facilities with no in-patient department has been changed; earlier, these were the facilities which account for 480 to 1,600 visits per shift, now this figure is over 480, without limitation;
  • The penitentiary-related facilities, including detention centers, penitentiaries, jails, with infrastructure facilities (health care facilities, industrial complexes and other facilities) are now referred to the high level of responsibility; earlier those were referred to Level Two.
  1. Regarding the facilities of Normal Level of Responsibility (Level 2):
  • Shopping and entertainment facilities, with the capacity of 800 to maximum 1,200 people staying there at a time, have been added; earlier, the shopping and entertainment centers were not marked separately – they were listed among sport and entertaining facilities and religious facilities, and their capacity was set at 50 to maximum 500 people at a time.
  • Freestanding warehouses and storages, which are part of the production and commercial facilities, have been given more detailed characteristics; these are the warehouses which are two-storey buildings and higher with area of more than 2,000 sq.m. and the storage areas that require special conditions for storage of goods and materials;
  • Surface or underground parking lots or garages were previously determined by their capacity – the number of cars they can host. Now they are determined by the number of floors below the ground and above the ground (more than five floors below the ground and over two floors above the ground).
  1. Regarding the facilities referred to the Normal Level of Responsibility, not referred to technically complex ones:
  • Sport and entertaining facilities and covered religious facilities or open structures with capacity of to 150 people staying there at a time; shopping and entertainment facilities with capacity of to 800 people staying there at a time;
  • Surface or underground parking lots or garages were previously determined by their capacity – the number of cars they can host. Now they are determined by the number of floors below the ground and above the ground (more than five floors below the ground and over two floors above the ground).
  1. Regarding the facilities referred to the Low Level of Responsibility (Level 3):
  • Buildings and structures of temporary, seasonal and auxiliary purpose (greenhouses, pavilions, and small warehouses) have been given more detailed characteristics; these are the warehouses having up to two floors with area of maximum 2,000 sq.m.
  1. Regarding the facilities referred to technically complex facilities of housing and civil purpose:
  • The capacity of shopping and entertainment facilities has been changed to maximum 800 people at a time; earlier, the capacity was 1,000 people or more.
  • Sport and entertainment facilities, covered religious facilities, or open structures with capacity of more than 150 people staying there at a time have been added separately. Previously, they were listed together with the shopping and entertainment facilities and their capacity was 1,000 people or more.
  1. Regarding the facilities of housing and civil purpose (buildings and structures and their complexes), not referred to technologically complex ones:
  • Shopping and entertainment facilities with capacity of to 800 people staying there at a time;
  • Sports and entertainment facilities, covered religious facilities, or open structures – their capacity has been changed to up to 150 people; earlier, the capacity was no more than 500 people at the time at any one mass ceremony.
